Introduction and Governing Law
These are the Terms & Conditions of Sale applicable to on-line purchases from Face Paint Shop Australia ("FPSA"). These conditions should also be read in conjunction with FPSA's General Website Terms and Conditions of use.
These terms and the laws of New South Wales, Australia, apply to all transactions for the purchase of FPSA products ("Products") from FPSA through its web site at www.facepaintshopaustralia.com and any associated web page (the "Site"). These terms represent the complete Agreement between FPSA and the Buyer covering the sale of Products from this Site. Except for terms implied by applicable legislation, FPSA does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms. The Buyer's completion of the Order form on this Site will constitute an offer to the Buyer to purchase Products (the "Order"). All Orders are subject to acceptance by FPSA.
By placing an order the Buyers is offering to purchase a product subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and subject to any delays resulting from postal delays, weather events or otherwise for which we will not be responsible.
When placing an order the Buyers sundertake that all details provided to us are true and accurate, that the Buyer is the authorised user of the credit or debit card or account used to place your order and that there are sufficient funds to cover the cost of the goods.
The prices to be paid by the Buyer for all Products will be FPSA's current selling price on the date of receipt by FPSA of the Order, less any applicable discounts in effect at that time. All Orders will attract a delivery charge as set out on the Delivery and Returns and Checkout pages.
FPSA reserves the right to change its prices from time to time without prior notice to the Buyer. All prices in this website include Australian Goods and Services Tax (GST) at 10%.
The GST payable by the Buyer will be shown on Checkout: Shopping Summary screen and on the invoice sent to the e-mail address recorded by the customer. Delivery charges to the nominated address will be advised to the Buyer on the Delivery Charges and Checkout screens.
Coupons and Vouchers
From time to time FPSA presents customers with coupons and vouchers, and may be used/redeemed on Shop Online to reduce the order value. Only one voucher may be used at a time, and cannot be combined and used on the same order. Coupons and vouchers must be used prior to their expiry date, and in accordance with the conditions issued with that voucher.
E-mail Address & Invoices
It is important that you enter a valid e-mail address, as invoices are automatically e-mailed to that address. Please ensure your e-mail address is accurate. Also check your spam folder for undelivered invoices. An invoice may or may not be shipped with the goods.
If a Product is "out of stock" when FPSA processes an Order, FPSA will contact the Buyer to discuss revised delivery times or refund options.
When an order is placed, the Buyer will receive an acknowledgement e-mail confirming receipt of the order: this email will only be an acknowledgement and will not constitute acceptance of an order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
All Orders made by the Buyer under this Agreement must be placed using the webpages on this Site and must specify the information requested, including (but without limitation):
(a) Quantity and description of Products
(b) The full street address to which the Product is to be delivered
(c) Current billing address to which credit card statements are sent.
The Buyer must complete all information requested on this website and credit card payment sites for the Order to be processed by FPSA.
FPSA will not accept orders:
(a) From trade customers who are buying Products for resale;
(b) If the Buyer does not offer to pay by one of the payment options listed in this website;
(c) If the Buyer's credit card provider or PayPal does not confirm the payment; or
(d) On back-ordered or out-of-stock products.
FPSA will send the Buyer an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order. If FPSA does not accept the Buyer's Order for any reason, it will inform the Buyer by email in the same manner.
Order Modification or Cancellation
Please ensure order and address details are correct. Once an order is placed we cannot guarantee it can be modified or stop it from being shipped. The Buyer will need to contact the contact FPSA via the email if any changes or refunds are requested. Once the order has been returned to Face Paint Shop Australia in unopened condition, the Buyer's will be refunded within 10 working days less the freight fee.
Australia Post deliveries occur usually within 2-7 business days after the goods leave our warehouse. Australia Post Express usually takes 1-3 days to arrive at mainland capital cities except Perth and Darwin. A Buyer cannot arrange collection of Orders from Face Paint Shop Australia.
If a signature is required upon delivery and if no one is available at the delivery address to receive the Products, FPSA's delivery agent will leave an "unable to deliver" card at the address and the Buyer should follow the directions on that card to obtain delivery of the Products. When Australia Post is unable to deliver your parcel, it will be returned to your nearest local post office for your collection.
The Buyer acknowledges that FPSA may, from time to time, be subject to production, delivery or other unforeseen delays and that FPSA may allocate distribution of Products ordered among its customers at its sole discretion.
If Buyer's Order has not been delivered within a reasonable time, the Buyer should first refer to FPSA dispatch e-mail, clicking on the link to check the status of the shipment. By entering the consignment number on the Australia Post website, the Buyer can see the delivery status of their order. In most cases the undelivered order is waiting collection at the Buyer's local post office. If the product is lost in transit please contact FPSA via email.
FPSA reserves the right to make partial delivery of an Order. Please ensure delivery addresses are correct prior to placing order, once an order is processed by our team, we are unable change or redirect the delivery address.
Payment for Products purchased from FPSA via the Site can be made by the following methods:
- Direct bank deposit or transfer
- VISA or MasterCard credit cards or funds transfer via PayPal
Credit card information submitted by the Buyer will be verified by the credit card provider or PayPal, and the Buyer will be advised if their Order has been accepted. The Buyer agrees to submit to FPSA such information as may be reasonably requested by FPSA or the credit card provider for the authorization and verification of its credit card purchases.
Please note that Buyer credit card numbers and details are not processed or retained on FPSA systems. Credit card providers may activate additional security measures, such as Verified by Visa or MasterCard SecureCode on your credit card (requiring an additional password). We have no control or access to credit card authentication systems. For all credit card issues you must contact your bank or credit card provider.
FPSA reserves the right to exercise its lawful remedies if a dispute arises over payment through the Buyer's credit card provider. In particular, but without limitation, if the Buyer's credit card provider rejects a payment when due, FPSA at its discretion may delay or cancel delivery of Orders placed by the Buyer.
FPSA may also offset and deduct from any refund due to the Buyer all sums owed by the Buyer to FPSA. If the Buyer's account is placed in collection, FPSA will be entitled to claim all reasonable expenses for collection, including legal fees incurred in connection therewith.
Broken, Damaged or Faulty Products
A Product is deemed to be broken, damaged, or faulty if it fails to function according to its specifications within 14 days of its purchase date. If a product arrives broken, damaged, or faulty the Buyer must contact Face Paint Shop Australia via email and discuss the problem. If FPSA considers the Product to be broke, damaged or faulty, we will issue a Return Authorisation Number and will send a prepaid envelope and return instructions to the Buyer.
FPSA will pay the shipping cost associated with the return of a broken, damaged of faulty Product, provided that the Buyer uses the FPSA nominated carrier. FPSA will deliver a replacement Product to the Buyer promptly upon receipt of the deemed broken, damaged or faulty product.
FPSA will arrange delivery of all Products to the Customer using its nominated shipping carriers. A Buyer must not arrange its own courier to collect the Products from FPSA.
Incorrect Ordering of Consumables & Other Items
Before returning an incorrect consumable, the Buyer must email and obtain from FPSA return instructions. At its own cost, the Buyer must return the consumable to FPSA within thirty (30) days, in a new, unused and unopened condition. We will not accept used items for return.
Incorrect Supply of Order
If due to a warehouse or other error on the part of FPSA, the Buyer receives a Product which does not conform to its Order, the Buyer must contact FPSA within 7 days of receipt of the Product. After returning the original Product to FPSA, provided that the returned Product is in new condition with its original packaging unopened, FPSA will ship the originally ordered product.
Products Damaged in Transit
Claims for alleged damage to Products caused in transit from FPSA to the destination specified by the Buyer must be notified to FPSA as stated below within 48 hours of receipt of delivery and the consignment note must be marked as "Received Damaged".
The Buyer must contact the FPSA Website Administrator by email and obtain return instructions. The Buyer must also supply a copy of the consignment note to FPSA. The Buyer will be asked to supply image/s to confirm the itme is damaged, broken, or faulty.
Delivery Outside Australia
FPSA is unable to accept Orders or deliver to addresses outside Australia, except for New Zealand.
Not For Export Outside Australia
Products ordered via the Face Paint Shopa Australia website are for Australian use only, and are not to be exported.
Amendment of Terms and Conditions
FPSA may revise these terms and conditions from time to time. Buyers should therefore periodically visit this page to familiarise themselves with any such revisions.
FPSA offers a limited range of Products in the "Seconds" section of this website. Some units may have slight cosmetic damage to the unit or the carton, however the product within is deemed to be functional.
From time to time FPSA offers a limited number of products that may have slight cosmetic damage to the outside packaging via the "Seconds" page of this website. The products themselves are deemed to be functional and undamaged, and have not been used. Package-damaged products available on this website are only offered for sale to end users and are not offered for re-sale by resellers.
