Facebook Photo Contest Terms & Conditions (“Contest”)

Terms and Conditions
1. The Promoter

Face Paint Shop Australia (ABN 14 097 362 897) of 14 Edinburgh Drive, Maclean NSW 2463.

The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.

2. Who May Enter

The Promoter is conducting an "Christmas Face Paint” photo contest promotion (“Contest”) for face painters of all levels (“Contestant”).

Entry is only open to Contestants who meet ALL of the following requirements:

• Submit a photo of a face paint / body paint design via the Facebook page www.facebook.com/facepaintshopaustralia under the “Christmas Face Paint” contest tab
• Complete the Contest entry form with valid contact details
• Are over 18 years old
• Multiple entries are welcome.

The Contest is not open to:

• employees of the Promoter;
• parties who are otherwise directly involved with this Contest; or
• any immediate family member of the above mentioned parties.

3. Contest Period

Contest entry opens at 4.00 PM on Tuesday 17th November 2015 until Friday 18th December 2015 at 5.00PM Australia Eastern Daylight Time (AEDT).

4. Cost

There is no cost or fee to enter the Contest.


5. How to Enter

During the Contest Period, Contestants must submit a photo that best illustrates the theme of "Christmas face paint designs". Contestants should include details of the design, including products and tools used, in their photo caption. The design may be painted on the face, arm, or leg of the model.

To enter the Contest: Online: www.facebook.com/facepaintshopaustralia and go to the “Christmas Face Paint” contest tab. Follow the directions provided to complete the entry form; upload photo, consent to Contest Terms & Conditions, and submit. Photo must be submitted in JPEG format and cannot exceed 2MB in size. All entries must be received by Friday 18th December 2015 at 5.00PM Australia Eastern Daylight Time (AEDT).


6. Content of Entries

Entries must not include the faces or other personal information of any persons other than the Contestant, unless express written permission has been granted by the model (if over 18 years of age), or in the case of a minor, the legal guardian of that model. The Contestant indemnifies the Promoter against any legal action should this condition not be met.

The Promoter reserves the right to reject any entry, including any entry deemed by the Promoter, in its sole discretion, to be inappropriate.

Without limiting the Promoter’s discretion, entries must not include any content that:

1) is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;

2) promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;

3) is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Entries;

4) defames, misrepresents or contains disparaging remarks about other people or companies;

5) contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;

6) contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;

7) communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or

8) violates any law.



7. Prizes and Total Prize Pool

The prize pool comprises three (3) individual prizes, total prize pool valued at $200 Australian Dollars:


First prize: One (1) gift certificate to be redeemed at www.facepaintshopaustralia.com valued at $100 Australian dollars, including GST

Second Prize: One (1) gift certificate to be redeemed at www.facepaintshopaustralia.com valued at $75 Australian dollars, including GST

Third Prize: One (1) gift certificate to be redeemed at www.facepaintshopaustralia.com valued at $25 Australian dollars, including GST

8. Winners for the prizes

All eligible entries received during the Contest Period will be published on Face Paint Shop Australia’s Facebook page under the “Christmas Face Paint” contest tab.

The Top 20 valid entries receiving the most “Likes” will go into the shortlist. Winners will be selected from the shortlist pool by a panel of judges appointed by the Promoter and will be based on photo’s relevance to the Contest theme and its creativity. The Promoter reserves the right to change the winner selection method at its sole discretion.

Voting opens at 9am on Monday 23rd November 2015 and closes at 11.59pm on Sunday 20th December 2015. Winners will be decided and announced by Tuesday 22nd December 2015

9. Notification of Winners

The Promoter will send an email to shortlisted Contestants on or around 21st December using the email address supplied on the Contest entry form. Each shortlisted Contestant is responsible for monitoring his or her email account for notification and receipt or other communications related to this Contest.

Winners will be notified by email within 5 working days after the decision is made. Winners must claim their prize within fourteen (14) days of the date of notification. Prizes will be delivered electronically to the email address provided, or posted to the winner's residential address in Australia within 6 weeks of the draw.

Winners may be required to provide identification and supporting documentation necessary to prove they comply with these Terms & Conditions, including that they are over 18 years of age, and/or the written consent of a minor by a legal guardian.

Winners not residing in Australia will be emailed their gift certificate and this may be redeemed only at www.facepaintshopaustralia.com and is not exchangeable for cash.

If a winner cannot be reached by the Promoter within fourteen (14) days using the contact information provided at the time of entry, that winner shall forfeit the prize.

Upon the request of the Promoter, the winners may be required to return a Release and Prize Acceptance Form. If a winner fails to comply with these official rules, that winner will be disqualified.

10. Publication Details

Winners will be published on multiple platforms, including but not limited to www.facepaintshopaustralia.com, our partner blog www.facepaintingschool.com.au, www.facebook.com/facepaintshopaustralia, www.twitter.com/facepaintschool, www.pinterest.com/facepaintschool, and other communication platforms used by the Promoter.

11. Exclusion of Liability

(a) To the maximum extent permitted by law, the Promoter is not liable for any loss suffered or sustained by any Contestant or any other person however caused including but not limited to consequential (including economic) loss by reason of any act or omissions, deliberate or negligent, by the Promoter or its employees or its contractors or its agents in connection with supply of the prizes awarded to the prize winners.

(b) The Promoter’s decision on all matters pertaining to this Contest will be final.

(c) The Promoter is under no obligation to provide reasons for any of its decisions.

(d) The Promoter is under no obligation to engage in any form of correspondence whatsoever with Contestants or their representatives in matters relating to the Contest.

(e) A prize must be taken as offered and cannot be varied.

(f) A winner may be liable to declare a prize for tax purposes. The Promoter takes no responsibility for any tax payable on a prize. If any tax is payable on a prize it is the sole responsibility of the winner.

(g) The Promoter accepts no responsibility if the prizes are lost, stolen, damaged or tampered with in any way.

(h) The Promoter does not take responsibility for misdirected mail or mail received late and the Promoter will not be liable for any loss resulting from transit of prizes.

The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering the Contest each Contestant releases Facebook from any and all liability in relation to the Contest.

12. Privacy

The Promoter collects personal information from all Contestants in order to determine their eligibility to enter into the Contest and to administer and complete this Contest. It is a condition of entry that the Contestants read and agree to the Promoter’s privacy policy which can be found at http://www.facepaintshopaustralia.com/privacypolicy.

It is also a condition of entry that each winner consents to the publication of their name, city/Country of origin and their photos in any publication relating to this Contest.

If the requested information is not provided, the Contestants will not be eligible to participate in the Contest or to claim a prize and their entry may be discarded.

13. Inconsistency

To the extent that there is any inconsistency between these terms and conditions and any other published material, these terms and conditions will prevail. By participating in the Contest, each Contestant acknowledges that these terms and conditions are legally binding.

The Promoter reserves the right to withdraw or amend the Contest as necessary due to circumstances outside its control.
